Prevention of Corruption Act New Amendment

In May 2009, the Anti-Corruption Bureau (ACB) drafted a proposal for amendment of the Prevention of Corruption Act (Chapter 131). An overview amendment was drafted by the ACB to incorporate provisions to facilitate further power of investigation by the ACB and also to comply with United Nation Convention Against Corruption (UNCAC) which was ratified by Brunei Darussalam in December 2008.
The amendment to the six sections of the Prevention of Corruption Act (Chapter 131) (PCA) had been consented by His Majesty the Sultan and Yang DiPertuan of Brunei Darussalam on the 8th day of February 2010.
In the amendment, the provision on the Duties of Director and Officers of the Bureau is inserted. This lays down all the duties of the officers of the Anti-Corruption Bureau based on the 3-prong strategies taken in combating corruption (i.e investigation, prevention and education).
Provisions as to bail or bond is also inserted which empowers the Bureau to issue bail or bond for an arrested person. Prior to this, the ACB refers all arrested person to the police for their release on police bail bond. Thus, with this new provision, the Director or the officers of Bureau, authorised by the Director, has the power to release the arrested person by bail or bond.
With the new amendment, the Bureau is also given the power to investigate offences under any other written laws by Order of the Public Prosecutor authorising the officers of the Bureau to investigate into any offences under any written law, , all or any of the powers in relation to police investigations conferred by the Criminal Procedure Code (Chapter 7).
Section 22 of the PCA provides for legal obligation to give information on any subject which is the duty of the Officer of the Bureau to inquire into under the PCA or under any prescribed offence. Any person who fails to give such information as he is required to give is guilty of an offence and liable on conviction to a fine not exceeding $20,000 and 1 year imprisonment.
Section 24A provides for the admission of statements made under the PCA or any other written law.
Section 34A provides for penalty on those who resist or obstruct officers of the Bureau from executing their duties. Any person who resists or obstructs any Officer of the Bureau in the execution of his duty is guilty of an offence and liable on conviction to a fine not exceeding $20,000 and imprisonment for one year.
